Court Demands Answers From Delhi Government, Police Chief On Firecracker Ban Enforcement

The Supreme Court  reprimanded the Delhi government for failing to effectively curb the rising air pollution in Delhi, particularly in the aftermath of Diwali celebrations. The court emphasized the urgency of implementing pollution control measures, especially regarding firecracker usage.

 

Firecracker Ban Implementation Lacking

A Supreme Court bench led by Justice S. Oka observed that the ban on firecrackers in Delhi was “hardly implemented,” resulting in record-high pollution levels during Diwali. The court demanded that the Delhi government present proof of the enforcement of the firecracker ban, questioning the efficacy of the measures taken.

Immediate Response Sought from Delhi Government

The bench called on the Delhi government to immediately clarify the status of the firecracker ban, asking who was responsible for its enforcement and whether the order was passed under the Environment Protection Act. Justice Oka insisted that Delhi authorities respond promptly, stressing that accountability was needed in addressing air quality issues.

Consideration of a Permanent Firecracker Ban

Justice Oka urged Delhi officials and relevant authorities to deliberate on a “perpetual ban” on firecrackers, given their major contribution to Delhi’s air pollution. He pointed out that firecrackers were also being brought in from neighboring states and suggested the government start a public awareness campaign before Diwali to improve compliance and public understanding.

Directions for Next Steps

The court also directed the Delhi Police Commissioner and government to establish a solid enforcement mechanism for the ban to prevent the recurrence of this year’s situation. The Delhi government and police were tasked with developing clear, effective strategies for future Diwali celebrations to protect public health and reduce pollution.
