US U-turn on COVID-19 patent waivers heaps pressure on European Union ahead of India meeting

In a move that stunned the pharmaceutical industry and several European allies, the Biden-led administration, earlier this week, made a remarkable reversal on its stance in the debate over whether temporary waivers ought to be issued on COVID-19 vaccines. 

US Trade Representative Katherine Tai added, via a statement, that the US would actively engage in the World Trade Organisation’s “process” to arrive at a resolution over vaccine patent waivers as against any specific proposal put forth by a country, as both, India and South Africa did in October. 

But there are already signs that talks at the WTO are unlikely to be smooth. The European Union, along with the United States until this week, has been one of the most staunch opponents of vaccine waivers. 

Shortly after Tai’s statement, European Commission president, Ursula von der Leyen stated that she did not endorse President Biden’s plan casting more doubt on whether the impasse could be resolved swiftly. Germany, Europe’s largest economic power, also stated that the India and South Africa-backed proposal will have “significant implications for vaccine production as a whole.”

“The limiting factors in the production of vaccines are the production capacities and the high-quality standards and not patents,” a German government statement read. However, other countries like Italy and France have thrown their weight in support of the proposal with French President Emmanuel Macron previously saying he was “very much in favour” of relaxing intellectual property restrictions. 

What is the debate about?

At the heart of the arguments made by those who oppose vaccine patent waivers is the contention that doing so may compromise the incentives of large pharmaceutical manufacturers to invest heavily into new drug and vaccine development. 

Their ability to manufacture these drugs exclusively and set prices on these products are crucial to recouping that investment. Others like Microsoft co-founder and health philanthropist Bill Gates have also opposed the idea claiming that manufacturers of generic drugs cannot ramp up production fast enough while raising questions over vaccine quality. 

Meanwhile, proponents of the waiver firmly believe that enabling cross-border technology and knowledge sharing remains the only way to attract fresh investment into boosting manufacturing capacity, and ultimately, move toward a more equitable global distribution of vaccines. 

It is worth noting that, although hundreds of millions of vaccines have been manufactured and distributed across the world following their respective approvals, a large proportion of them have been procured by just a handful of wealthy nations like the US, the UK and Canada among others. 

Given what’s at stake, talks at the WTO, experts agree, could drag on for months. The WTO cannot begin any negotiations with manufacturers over which vaccine patents to deregulate until all 164 countries arrive at a unanimous agreement. 

When the idea was originally proposed by India and South Africa, it quickly garnered the support of roughly 60 countries. It remains to be seen whether the US’ U-turn could encourage other nations to follow suit. The US’ decision has also arrived at an awkward moment for the European Union which is due to hold a virtual summit with Prime Minister Narendra Modi on Saturday, to discuss a comprehensive free trade agreement that has encountered several delays. The unprecedented surge of COVID-19 infections in India is one of the key reasons why the global vaccine patent waiver debate has received a fresh pulse.
