‘Difficult To Handle:’ SC Refuses To Entertain Additional Pleas Challenging Waqf (Amendment) Act

The Supreme Court  refused to entertain 13 more petitions challenging constitutional validity of the Waqf (Amendment) Act, 2025. The apex court stated that it cannot add any more pleas as they would become difficult to “handle.” The apex court refused to hear 25 petitions including TMC leader Derek O’Brien, PDP and Congress leader Imran Pratapgarhi.

A bench comprising Chief Justice of India Sanjiv Khanna and Justice Sanjay Kumar said, “We are not going to increase the number of petitions now…This will keep on piling and would become difficult to handle.” The Supreme Court made it clear that it will not accept new petitions challenging the validity of the Waqf Amendment Act, 2025.

What Did SC Say?

The Supreme Court observed that most of the petitions challenging this law have similar facts. If the petitioners still want to put forward any new argument, then they can file an application in the already listed cases.

However, the apex court has asked the petitioners, including Firoz Iqbal Khan, Imran Pratapgarhi, Shaik Muneer Ahmad and Muslim Advocates Association, to intervene in main pleas if they have additional grounds to challenge the Waqf law.

“We will hear all…Five cases have been registered. If you want to argue additional points then move impleadment applications,” CJI added.

Earlier on Monday, the Supreme Court refused to entertain a plea filed by Senior Advocate Rauf Rahim challenging certain provisions of the Waqf (Amendment) Act, 2025. The senior lawyer had stated that his petition concerns other aspects of the Waqf Act, which are unrelated to issues such as ‘Waqf by User’ that are scheduled to be considered by the Chief Justice’s bench.

 

Notably, on April 17, the bench had decided to hear only five of the total number of pleas before it and titled the case: “In Re: Waqf (Amendment) Act, 2025.”
