‘They Want To Form Govt. From Jail Also,’ Amit Shah Takes A Dig At Opposition Over 130th Constitutional Amendment Bill

Union Home Minister Amit Shah, in a sharp attack on the opposition, stated that even today, opposition leaders are preparing to run the government from jail if convicted. Referring to their resistance to the 130th Constitutional Amendment Bill, Shah alleged that they aim to turn jails into power centres, where Chief Ministers, Prime Ministers, and top officials would take orders from behind bars.

Amit Shah stated this in an interview with ANI, where he extensively talked about the newly introduced bill, “The Constitution (One Hundred and Thirtieth Amendment) Bill.”

What Did Amit Shah Say?

“Even today, they are trying that if they ever go to jail, they will easily form the government from jail. The jail will be made CM House, PM House and the DGP, Chief Secretary, Cabinet Secretary or Home Secretary will take orders from the jail,” said the Home Minister.

On whether the bill will be passed or not in the Parliament, Shah appeared confident, stating that it will be surely “passed.”

“I am sure it will be passed. There will be many people in the Congress party and in the opposition who will support morality and maintain the moral ground,” Shah added.

About The Bill

The Constitutional Amendment Bill along with the Union Territories (Amendment) Bill, 2025, and the Jammu and Kashmir Reorganisation (Amendment) Bill, 2025 was introduced in the Lok Sabha during the Parliament Monsoon Session.

According to the 130th Constitutional Amendment Bill, individuals holding important constitutional positions, such as the Prime Minister, Chief Ministers, and Ministers of the Central and State Governments, will not be able to run the government while in jail.

While introducing these bills, Shah had stated that the laws resulting from these three bills will ensure the following:

No person, while under arrest and in jail, can govern as Prime Minister, Chief Minister, or Minister of the Central or State Government.

This bill includes a provision that allows an accused politician to seek bail from the court within 30 days of arrest. If they fail to secure bail within 30 days, on the 31st day, either the Prime Minister at the Center or the Chief Ministers in the states will remove them from their positions; otherwise, they will automatically become legally disqualified from performing their duties. If such a leader is granted bail after the legal process, they may resume their position.
